The court of appeals affirmed a district court judgment in part, reversed in part, and remanded the action for further proceedings. The court held that an Idaho woman who used FDA-approved medicine obtained over the internet to induce an abortion was likely to succeed on the merits of her constitutional challenge to Idaho’s abortion statutes that imposed the prospect of criminal liability on pregnant women who exercised their constitutional right to terminate their pregnancies before viability.
