Never before has the California Legislature set a limit on the length of civil depositions. That changed when the governor signed a law restricting depositions “to seven hours of total testimony” on Monday. The law takes effect Jan. 1, 2013.

The Consumer Attorneys of California were instrumental in pushing through this legislation on anecdotal evidence of the need for the restriction. The Legislature appears to have found rationalization in the fact this limit is similar to Federal Rules of Civil Procedure, Rule 30(d)(1) that limits a deposition to “one day of seven hours.” California now has a standard for the reasonable length of a deposition and moves its jurisprudence another step closer to federal practice.
