Cal.Sup.Ct.
S191934

The California Supreme Court affirmed a judgment. The court held that a trial court’s instruction that a defendant accused of murder, who had pleaded not guilty by reason of insanity had to be presumed sane during the guilt phase of his trial, although unnecessary, did not interfere with the defendant’s ability to argue that his paranoia caused him to kill the victim while acting in good faith but unreasonable self-defense.
