The court of appeals vacated a biological opinion of the federal Fish and Wildlife Service and remanded for further proceedings. The court held that, by relying on a legally flawed and inadequate biological opinion, the federal Bureau of Land Management violated its duty to ensure that its authorization of a pipeline project would not jeopardize the survival of listed fish species or adversely modify the species critical habitat.
