SAN FRANCISCO A federal class action against the maker of a faulty contact lens solution has settled and in the process wiped out an appeal drawing interest from consumer groups and federal food and drug regulators.
The U.S. Court of Appeals for the Ninth Circuit on Tuesday vacated a 2011 panel opinion in Degelmann v. Advanced Medical Optics, 10-15222. The court had been weighing a petition for rehearing en banc for nearly one year when attorneys filed a joint motion to dismiss the appeal in light of a confidential settlement agreement.
