Circuit Seems Ready to Uphold Conviction for Touting Skewed Clinical Results

SAN FRANCISCO Though they posed tough questions to both sides, Ninth Circuit judges appeared Thursday to be leaning toward upholding the groundbreaking criminal conviction and relatively light sentence of pharmaceutical executive W. Scott Harkonen.

The former CEO of Brisbane-based InterMune was convicted of wire fraud in 2009 for grossly misstating clinical study results in a company press release.
