The First Appellate District reversed a judgment. The court held that the trial court’s mishandling of a sexually violent predator’s petition for conditional release following the 2006 amendments to the Sexually Violent Predator Act resulted in the petitioner being denied his right to a jury trial and also shifted from the People to the petitioner the burden of proof on his need for continuing confinement.
