The court of appeals affirmed a district court judgment and remanded the action with directions. The court held that the district court did not commit Batson error where, despite expressly finding that there was no subjective racial bias on counsel’s part, it still denied a party’s peremptory challenge to one of two Alaska Natives out of concern that eliminating all Alaska Natives from the jury panel would create the appearance of purposeful discrimination.
