The court of appeals reversed a district court judgment and remanded the action for further proceedings. The court held that border agents require reasonable suspicion in order to carry out forensic examination of international travelers’ electronic devices. The court held further that, in this case, reasonable suspicion existed to conduct a forensic examination of a defendant’s laptop computer hard drive where he was the subject of a federal alert as a sex offender who traveled frequently out of the country, he was returning from a country known for sex tourism, and he was transporting a suspicious collection of electronic equipment.
