The Fourth Appellate District affirmed a trial court order denying a petition for writ of mandate. The court held that bringing a challenge to the validity of a proposed regulation during the public comment period is not a prerequisite to a judicial action seeking to challenge the regulation’s validity. The court held further that California Fish and Game Commission properly exercised its authority in adopting regulations creating marine protected and marine managed areas in the North Central Coast study region before completion of the master plan process and without first obtaining State Interagency Coordinating Committee review.
