The First Appellate District granted a petition for writ of habeas corpus. The court held that California state prison officials improperly confiscated the book The Silver Crown from a prisoner on grounds of obscenity where the work, while interlaced with pornography, did not lack serious literary value when viewed in its entirety. The court held further that the work was not properly deemed contraband on the ground that it was likely to incite violence.
