As class members in the $49 million BAR/BRI settlement continue to wait for their distribution checks, lawyers for five individuals who succeeded in unraveling key portions of the deal on appeal were granted immediate payment of more than $230,000 in fees and costs.

Kendrick & Nutley, a Pasadena law firm that represented the five objectors, moved last month for enforcement of an order earlier this year granting fees and costs for their work in the case. Specifically, for successfully arguing that McGuireWoods, the lead counsel for the class, should have its fees cut for an “egregious breach” of ethics highlighted by the U.S. Court of Appeals for the Ninth Circuit last year.
