One month after attorneys for employees in an overtime class action accused Hewlett-Packard Co. of trying to harass named plaintiff Eric Benedict with a countersuit, the Palo Alto-based tech behemoth launched back.

In court papers filed in San Jose federal court Thursday, HP argued that Benedict has rejected offers to toss out the countersuit, which claims Benedict illegally downloaded company data to a personal computer
