SAN FRANCISCO — Gov. Jerry Brown is vetting Therese Stewart, San Francisco’s chief deputy city attorney and the point woman on its legal fight for same-sex marriage, for a vacancy on the First District Court of Appeal.

If nominated and confirmed, Stewart would become the first openly lesbian woman appointed to the California Court of Appeal. Brown appointed the first gay man, James Humes, earlier this year.
