SAN FRANCISCO — There’s little common ground in a free speech fight between pharmacists and insurance claims processors.

The 13-year-old case has divided the U.S. Court of Appeals for the Ninth Circuit and put the federal court at odds with three California Court of Appeal panels. The Ninth Circuit had to call the case en banc just to punt it to the California Supreme Court.
