The court of appeals dismissed an appeal in part, reversed in part a district court order, and remanded the action for further proceedings. The court held that a challenge to California’s enactment of a Medicaid-related percentage payment reduction for certain service providers was rendered moot when the reduction expired while the case was on appeal. The court held further that the district court abused its discretion in denying the plaintiffs’ motion for a preliminary injunction because it misconstrued the Medicaid Act and applied deference to a federal agency decision where none was due. Finally, the district court’s dismissal of the plaintiff’s Medicaid Act claims had to be reversed where it relied on exactly the same reasoning.
