The court of appeals reversed a district court’s denial of a motion for a preliminary injunction and remanded the action for further proceedings. The court held that immigrant recipients of deferred action under the federal policy known as Deferred Action for Childhood Arrivals were entitled to a preliminary injunction barring Arizona’s enforcement of its policy prohibiting them from obtaining a state driver’s license by using their Employment Authorization Documents where they demonstrated that the state policy resulted in disparate treatment that impinged on their equal protection rights.
