The Second Appellate District reversed a judgment and remanded. The court held that the statutory presumption that a trustee who commingles trust funds with his or her own funds violates a fiduciary duty to the trust is properly to be applied to the benefit of beneficiaries of the trust, not to the benefit of a creditor of the trustee.
