SAN FRANCISCO — U.S. District Judge Edward Chen dismissed the bulk of a proposed privacy class action against mobile handset makers who included Carrier IQ Inc.’s tracking software on their phones.
In a 96-page decision, Chen granted the phone makers’ motion to dismiss federal Wiretap Act claims, which carry statutory damages of up to $10,000 per violation. The judge dismissed claims under the Wiretap Act and most of the plaintiffs’ state law claims without prejudice, offering them a chance to file a third amended complaint in the case by March 23.
