C.A. 3rd;
C073059

The Third Appellate District reversed a trial court order denying class certification and remanded the action for further proceedings. The court held that an ascertainable class existed where the plaintiff described common characteristics that would allow a potential class member to identify himself as having a right to recover, along with an objective means to identify class members when specific individual identification became necessary. The court held further that the absence of means for identifying class members from a defendant’s records did not preclude the finding of an ascertainable class.
