The Sixth Appellate District affirmed a judgment for fees. The court held that a trial court did not err in awarding attorney fees to a defendant who prevailed on a plaintiff’s bad faith assertion of misappropriation of trade secrets where the defendant did no more than attempt to lawfully recruit the plaintiff’s employees and the plaintiff ultimately dismissed its suit to avoid an adverse determination on the merits.
