The Appellate Division of the Los Angeles Superior Court affirmed a judgment. The court held that a Los Angeles medical marijuana business was not entitled to limited immunity from prosecution under the Los Angeles Municipal Code where it failed to provide the city with documents establishing that its storefront was open for business as of the effective date of the city’s previous interim control ordinance regulating such businesses. The court held further that the business was disqualified from asserting limited immunity where it was located within 600 feet of another medical marijuana business, without regard to whether that business could itself assert statutory limited immunity.
