The court of appeals affirmed a district court judgment of conviction and sentence. The court held that for purposes of federal law criminalizing the theft or misapplication of funds belonging to an Indian tribal organization, funds paid from an Indian tribal organization to a contractor continue to belong to the organization so long as it maintains sufficient supervision and control of disbursed funds and their ultimate use. The court held further that evidence proffered at trial was sufficient to prove that a contractor converted or misused Indian tribal organization property where the contractor commingled disbursed funds, paid as reimbursement for completed work, with his own finances and left subcontractors unpaid.
