Lateral hires of nonattorney staff, such as paralegals, executive assistants and secretaries, are becoming as frequent as the lateral hiring of attorneys. While rarely thought of in the context of ethics issues, such as conflicts of interest, nonattorney staff hiring involves its own set of challenges—and sometimes the consequences can be quite serious. Yet, many firms take few precautions when hiring new nonattorney staff, and they fail to implement the appropriate procedures after problems arise.
