The court of appeals granted a petition for review of a decision of the Board of Immigration Appeals and remanded the action for further proceedings. The court held that the BIA did not err in determining that an attempted coup against the Philippine government was unlawful and that a petitioner characterized as inadmissible for engaging in terrorist activity “engaged” in the coup by planning it. The court held further that the Board erred by failing to apply clear error review to the immigration judge’s finding that the coup participants did not have an intent to endanger others.
