The court of appeals affirmed a district court judgment and injunction in part, reversed in part, and remanded the action for further proceedings. The court held in an amended opinion that a U.S. Army regulation imposed a judicially enforceable duty that the Army provide former chemical and biological agent test subjects with newly acquired information that could affect their well-being. The court held further that the Army had a regulatory duty to provide medical care to volunteer subjects without regard to whether some former subjects might be entitled to medical care from the Department of Veterans Affairs.
