The court of appeals reversed a district court order denying a motion to suppress and remanded the action for further proceedings. The court held that a probationer’s Fourth Amendment right to be free of unreasonable searches and seizures was violated when probation officers conducted two warrantless, suspicionless searches of his cell phone. The court held further that the unlawfulness of the searches rendered inadmissible evidence found on the phone that led to the probationer’s conviction for being a felon in possession of a firearm and ammunition.
