Lynne Hermle and Jessica Perry, employment partners in Orrick, Herrington & Sutcliffe’s Silicon Valley office, had hopes of keeping the gender discrimination suit against venture capital firm Kleiner Perkins Caufield & Byers out of the public eye. It was one of the key reasons that they fought to push Ellen Pao’s case into arbitration.

But when they first walked into Judge Harold Kahn’s courtroom in San Francisco, it was packed—and not with other lawyers. “There were an enormous number of people in jeans with laptops,” she says, now four years later. “These were not likely to be people coming up to argue before Judge Kahn.”
