The court of appeals reversed a district court’s dismissal of an action brought under the Federal Tort Claims Act. The court held that the independent contractor exception to the Act did not bar prisoners’ claims alleging breach of the federal government’s duties to prisoners housed at a correctional facility in California that was struck by an epidemic of an infectious disease.
