The court of appeals affirmed district courts’ summary judgments in cases consolidated on appeal. The court held that the terms of communications carriers’ private interconnection agreements, as informed by their conduct prior to arbitration, authorized an incumbent local exchange carrier to initiate negotiations with competitive local exchange carriers and then force binding arbitration before state telecommunications regulatory commissions pursuant to the Telecommunications Act of 1996 after the negotiations failed.
