The court of appeals affirmed in part and reversed in part a district court’s dismissal of a complaint and remanded the action for further proceedings. The court held that the Arizona Students’ Association stated a First Amendment unlawful retaliation claim by alleging that the Arizona Board of Regents ceased collecting and remitting the Association’s fees in retaliation for the group’s support of a state ballot initiative.
