The court of appeals affirmed a district court order denying a special motion to strike a complaint pursuant to California’s anti-Strategic Lawsuit Against Public Participation statute. The court held that the plaintiff presented sufficient evidence to go forward with her defamation suit, which alleged that employees of a tabloid newspaper acted with actual malice when they published an article implying that she was an HIV-positive sex worker.
