As the final quarter of the year quickly approaches, the time is ripe to consider client file retention and disposal practices. For firms that have certain protocols in place already, this involves a review of existing policies. For firms that have no written procedure providing how long old files are to be maintained, the resulting ad hoc system means that files are either kept forever or destroyed on a case-by-case basis.

Under a system lacking defined parameters, important files may be accidentally destroyed or lost among those that are decades old. At worst, a firm could become the object of a bar complaint or legal malpractice claim.
