The Sixth Appellate District granted a petition for writ of habeas corpus. In the published portion of its opinion, the court held that the California Department of Corrections and Rehabilitation (CDCR) may not deem a prisoner’s administrative appeal untimely when the appeal is submitted within the 30-day period allowed by regulation, even if the CDCR does not receive the appeal until after the 30-day period has expired.
