The Appellate Division of the Los Angeles Superior Court reversed a trial court order denying a motion for attorney fees and remanded. The court held that a landlord’s unlawful service of a notice to pay or quit while a tenant’s leased premises are in substandard condition can be determined by a trial court on noticed motion for purposes of deciding whether a prevailing tenant is entitled to recover her attorney fees under Code of Civil Procedure §1174.21.
