The court of appeals remanded an action for fact-finding regarding multiple defendants’ Brady claims and vacated an individual defendant’s conviction and remanded for new trial. The court held that disputed facts required remand for further fact-finding where defendants alleged joint Brady claims arising from the government’s failure to divulge the full extent of benefits afforded to a cooperating trial witness. The court held further that the district court erred in rejecting, arbitrarily and without explanation, a defendant’s letter requesting appointment of counsel due to ongoing difficulties with his retained attorney.
