The court of appeals granted a petition for review of an order of the Board of Immigration Appeals. The court held that the BIA erred in equating the Mexican government’s enactment of official policies recognizing the rights of gays and lesbians with a reduction of homophobia in the country’s rural communities, especially in light of reports indicating that violence against gays and lesbians in those communities had actually increased, and not decreased, since the enactment of the new policies.
