The court of appeals reversed a district court order, vacated a judgment of conviction, and remanded. The court held that a federal agent acted with reckless disregard for the truth in applying for a warrant based on the suspect’s possession of two “pornographic” images which prior law enforcement agents had concluded were not, in fact, pornography.
