The Third Appellate District conditionally reversed a judgment and remanded. In the published portion of its opinion, the court held that because the prosecutor stated both neutral and non-neutral reasons for exercising peremptory challenges as to two openly gay jurors, the trial court needed to conduct further proceedings to determine if the prosecutor would have exercised those challenges even in the absence of the admitted non-neutral reason.
