The California Supreme Court affirmed a court of appeal decision. The court held that where restitution was not ordered as a condition of probation, a driver convicted of fleeing the scene of an accident could not be ordered to pay restitution for any economic loss suffered by the victim beyond that loss incurred, if any, as a direct result of the defendant’s flight from the scene.
