The California Supreme Court reversed a decision of the court of appeal. The court held that a defendant’s consent to the reseating of a prospective juror found to have been improperly challenged on the basis of race, in violation of People v. Wheeler (1978) 22 Cal.3d 258, may be implied from defense counsel’s failure either to object or to demand dismissal of the entire venire.
