The court of appeals affirmed in part, reversed in part, vacated in part, dismissed in part a district court order, and remanded for further proceedings. The court held, among other things, that a BART police officer was not entitled to qualified immunity from a father’s Fourteenth Amendment claim for loss of familial companionship on the basis that the father and his son lacked a sufficiently strong bond to support the claim.
