C.A. 3rd
C067800

The Third Appellate District affirmed a judgment. The court held in the published portion of its opinion that former spouses who agreed to private mediation of their marital dissolution were not required to strictly comply with the financial disclosure requirements of Family Code §§2104 and 2105. The court held further that Placer County Local Rule of Court 30.7 was invalid to the extent it imposed requirements on a mediated settlement agreement beyond those set out in state law. Finally, the court held that a former spouse’s assertion of undue influence during mediation was precluded by the mediation confidentiality imposed under the Evidence Code.
