The Second Appellate District granted in part and denied in part a petition for writ of mandate. The court held that a plaintiff failed to show that the alleged failure of the State Department of Mental Health to conduct a statutorily mandated evaluation of an incarcerated rapist to determine if he was subject to commitment under the Sexually Violent Predators Act was the proximate cause of the inmate’s release and subsequent reoffense.
