The California Supreme Court reversed a decision of the court of appeal and remanded. The court held that the Department of Corrections and Rehabilitation’s compliance with the statutory procedures for the evaluation and classification of a state prison inmate as a mentally disordered offender was an issue of law, and not an issue that had to be proved to the trier of fact in proceedings under the Mentally Disordered Offender Act.
