C.A. 2nd
B250802
The Second Appellate District denied a petition for writ of mandate. The court held that the trial court did not abuse its discretion, in the course of postconviction habeas proceedings to establish actual innocence, in denying the petitioner’s motion to examine a prosecution witness who had identified the petitioner as his assailant prior to trial, subsequently recanted, and later testified against the petitioner at trial, and who now promised to recant once again.
