The court held that where a defendant reached a plea agreement after a jury had been empaneled in his prosecution, and the district court accepted the guilty plea and declared a mistrial with the defendant’s consent, double jeopardy did not preclude the defendant’s re-indictment after he later rescinded his guilty plea.
