The Fourth Appellate District reversed a judgment and remanded the action with directions. The court held that spot zoning may occur whether a small parcel is subject to either more or less restrictive zoning than surrounding properties. The court held further that when deciding whether impermissible spot zoning has occurred, a court must determine whether spot zoning has taken place in the first instance, and whether any such spot zoning is in the public interest.
