The court of appeals vacated a district court judgment and remanded the action for a new trial. The court held in an en banc opinion that a district court prejudicially abdicated its evidentiary gatekeeping role by failing to make findings of relevancy and reliability before admitting plaintiffs’ expert testimony on the theory that every asbestos exposure is causative as to asbestos-related disease.
