The court of appeals affirmed in part and vacated in part a district court’s denial of a federal habeas petition. The court held in its en banc opinion that an Arizona capital defendant’s defaulted claim of ineffective assistance of post-conviction review counsel had to be remanded for district court reassessment whether he could establish cause and prejudice to excuse the procedural default.
